What is a Will?

What is a Will and Why Should You Have One?

A Will is a legal document that sets out your wishes for what should happen to your assets and belongings after you pass away.

A Will allows you to choose who you want to receive your property, money and personal possessions, and who you trust to carry out your wishes. It can also include important decisions about who you would like to care for your children if you have young children and something happens to you.

Having a valid Will gives you greater control over what happens after your death and can help make an already difficult time easier for the people you leave behind.

Why is having a Will important?

Many people put off making a Will because they believe they do not have enough assets, they are too young, or they can deal with it later. However, having a Will is important for anyone who wants to have a say in what happens to their estate.

A Will can help you:

  • decide who receives your assets;

  • provide for your loved ones;

  • appoint a trusted person to manage your estate;

  • reduce uncertainty and potential disputes between family members;

  • make your wishes known clearly.

Without a Will, you lose the ability to choose who receives your assets and your estate will be distributed according to the laws that apply in your state or territory.

What happens if I die without a Will?

If you die without a valid Will, you are said to have died intestate.

When this happens, the distribution of your estate is determined by legislation rather than your personal wishes. This may mean your assets do not go to the people you would have chosen, or that the process becomes more complicated for your loved ones.

A lack of a Will can also create additional stress, delays and disagreements at a time when your family may already be grieving.

What can a Will include?

A Will can include instructions about many important matters, including:

  • who should receive your assets;

  • who should manage your estate (your executor);

  • specific gifts of money, property or personal items;

  • charitable donations;

  • guardianship wishes for children;

  • funeral wishes or personal preferences.

Your Will should be prepared to reflect your personal circumstances, family relationships and financial position.

Who should have a Will?

A Will is important for adults of all ages and backgrounds.

You should consider making or updating a Will if you:

  • have children;

  • own property;

  • have savings, investments or valuable possessions;

  • are married or in a de facto relationship;

  • have separated, divorced or entered a new relationship;

  • have experienced significant changes in your family or financial circumstances.

Can I write my own Will?

While DIY Will kits are available, a Will must meet specific legal requirements to be valid. Mistakes, unclear wording or missing important provisions can create uncertainty and disputes after your death.

A properly prepared Will helps ensure your intentions are clearly expressed and legally effective.

How often should I update my Will?

Your Will should be reviewed regularly, especially after major life events such as:

  • marriage or separation;

  • divorce;

  • the birth of a child;

  • buying or selling property;

  • significant changes to your assets;

  • the death of a beneficiary or executor.

Keeping your Will updated helps ensure it continues to reflect your current wishes.
