We handle everything from start to finish. This is a complete, tailored BFA service — we draft the agreement, provide your legal advice and issue the Solicitor's Certificate, all in one fixed fee.

Option 2: Another Firm Drafted Your BFA — $1,000 Fixed Fee

If your partner, spouse or ex has had a BFA prepared by their own lawyer, you'll need your own independent legal advice before signing. We review the agreement thoroughly, advise you on its terms and effect, and issue your Solicitor's Certificate.

  • Comprehensive review of the Agreement prepared by the other party's solicitor

Superannuation Split (Separation BFAs only) — Additional $500

Where a superannuation split is required under a separation BFA, an additional fixed fee of $500 applies — under either option above.

Where agreement is reached, we can also assist with documenting outcomes and provide advice regarding formalising arrangements where appropriate.

Fees and how we work

Our initial Trade Mark filing fee is $750, which includes:

  • An initial consultation with you

  • A Trade Mark availability search

  • Strategic advice on registrability and class coverage

  • Preparation and lodgement of your application

This fee is plus the official IP Australia fee of $250 per class for a one-dimensional business (for example, an accounting practice or florist, etc). However, if your business is multifaceted—such as life coaching combined with retreats, education, events—you may require multiple classes. IP Australia charges $250 per additional class.

Beyond filing, we operate on a staged fixed-fee basis, with each stage quoted and agreed before work commences.

Trade Mark matters in Australia are inherently unpredictable, and every application is unique. For this reason, it is not possible to quote a total cost upfront when dealing with IP Australia.
